1. Scope

1.2 The range of goods in our online shop is aimed exclusively at buyers who have reached the age of 18.

1.3 Our deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The general terms and conditions also apply to companies for all future business relationships, even if they are not expressly agreed again. The inclusion of a customer's general terms and conditions that contradict our general terms and conditions is already objected to.

1.4 The contract is concluded in German or English.

2. Offer and conclusion of the purchase contract

2.1 Written and oral offers from Brucelabrucejewelry are subject to change and non-binding. The offers from the online shop are to be understood as invitations to make an offer. 

2.2 By clicking the “buy now” button, you are making a binding purchase offer (§145 BGB). Immediately before placing this order, you can check the items in the shopping cart again and correct them if necessary.

2.3 We will confirm receipt of your order by email immediately after sending the order. A binding contract is concluded upon receipt of the order confirmation.

3. Prices

3.1 The prices at the time of the order apply. These prices are final prices and include the applicable German statutory VAT. The goods remain our property until the purchase price has been paid in full.

3.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases for which we are not responsible and must be borne by you. These include, for example, costs for the transfer of money through credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may apply in relation to the money transfer even if the delivery is not to a country outside the European Union but you make the payment from a country outside the European Union.

3.3 You can find out the period of validity of our limited offers where they are displayed in the shop.

4. Payment

4.1 Payments can be made either in advance, credit card or Paypal.

4.2 We are responsible for selecting the available payment methods. In particular, we reserve the right to only offer you selected payment methods for payment.

4.3 If you select the payment method in advance, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account immediately upon receipt of the order confirmation.

4.4 When paying by credit card, the invoice amount will be reserved on the credit card account when ordering and will be debited when the goods are dispatched.

4.5 If you pay with PayPal, you will be redirected to the website of the online provider PayPal during the ordering process. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, identify yourself with your access data and confirm the payment instructions to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. You'll get more information during the ordering process. The payment action will be carried out automatically by PayPal immediately afterwards.

4.6 We reserve the right to charge flat-rate reminder fees as default damages amounting to EUR 5.00 per reminder if you are in default of payment. You will be allowed to prove that damage was significantly less than the flat rate or no damage at all.

4.7 You agree that you will only receive invoices and credit notes in electronic form.

5. Repayments

5.1 We will automatically issue any refunds to the account you used for payment.

5.2 If you pay in advance, the transfer will be made to the account from which the transfer was made.

5.3 If you paid by Paypal or credit card, the refund will be made to the associated Paypal or credit card account.

5.4 If you used a gift voucher for your purchase, we will issue you a new voucher for the corresponding amount.

6. Discount coupons and their redemption

6.1 Discount coupons cannot be purchased, but are issued by us as part of advertising campaigns with a specific period of validity.

6.2 Discount coupons can only be redeemed within the specified period and only once as part of an ordering process. They cannot be used to purchase vouchers. Please note that discount coupons may be subject to a minimum order value.

6.3 The value of the goods must be at least equal to the amount of the discount coupon. Any difference to a higher value of goods can be offset using the payment options offered. The value of a discount coupon is neither paid out in cash nor interest. The discount coupon will not be refunded if goods are returned in whole or in part.

6.4 Discount coupons can only be redeemed before completing the ordering process. Subsequent crediting is not possible. The discount coupon cannot be transferred to third parties. Multiple discount coupons cannot be combined with each other unless we have agreed otherwise.

6.5 If you used a discount coupon when making your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below or equal to the respective value of the discount coupon corresponds.

7. Vouchers and their redemption

7.1 Gift vouchers are vouchers that you can purchase. However, these cannot be used to purchase additional gift vouchers. If the credit on a gift voucher is not sufficient for the order, the difference can be made up using the payment options offered.

7.2 Gift vouchers are valid for 3 years from the date of purchase.

7.3 Gift vouchers and credit can only be redeemed before completing the ordering process. The balance of a gift voucher will neither be paid out in cash nor interest. To redeem gift vouchers, please enter the code you received by email or post in the last step of the ordering process. Please make sure not to use spaces when entering.

8. Set-off/right of retention

8.1 You only have the right to offset if your counterclaim has been legally established, is not disputed or recognized by us or has a close synallagmatic relationship to our claim.

8.2 You can only exercise a right of retention if your counterclaim is based on the same contractual relationship.

9. Delivery/retention of title

9.1 Unless otherwise agreed, the goods will be delivered from our factory to the address you provided.

9.2 If the transport company sends the shipped goods back to us because delivery was not possible, for example due to incorrect delivery address information, you as the customer will bear the costs for the unsuccessful shipping as well as all costs incurred as a result. This does not apply if you are not responsible for the circumstances that led to the impossibility of delivery or if you were temporarily prevented from accepting the service offered, unless the seller had announced the service a reasonable time in advance . Furthermore, this does not apply with regard to the costs of sending the goods if you effectively exercise your right of withdrawal. If you effectively exercise your right of cancellation, the return shipping costs will be subject to the regulations set out in the cancellation policy.

9.3 If you collect the goods yourself (pick-up store), we will first inform you by email that the goods you have ordered are ready for collection. After receiving this email, you can collect the goods after consultation with us or within our business hours at Jonathan Johnson, Poolstr. 11, 20355 Hamburg. In this case, no shipping costs will be charged.

9.4 The goods remain our property until the purchase price has been paid in full.

9.5 Please note that the ordered goods will be delivered in advance as soon as we have received payment of the full purchase price and any shipping costs.

9.6 Our processing time is usually 4-7 working days. For possible exceptions, please refer to the respective product page. If an ordered item is not in stock, we reserve the right not to deliver. In this case, we will of course inform you immediately and immediately refund any consideration already received.

9.7 We endeavor to process your orders as quickly as possible, but cannot accept any liability for timely delivery.

We generally recommend ordering in good time or contacting us in urgent matters. We will always do our best to fulfill your wishes as best we can.

10. Transport damage

10.1 If goods are delivered with obvious transport damage, please complain about such errors immediately to the delivery person and please contact us as quickly as possible.

10.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance company.

11. Warranty/guarantee conditions

11.1 The statutory warranty provisions apply. The statutory limitation period for warranty claims is 2 years. If Jonathan Johnson grants special guarantees, this does not affect the statutory warranty claims.

11.2 Our products are 100% handmade and may have minor deviations. These features are characteristic and do not represent defects. The products shown are only example images.

11.3 Excluded from the warranty/guarantee are damages caused by natural wear and tear, improper use and lack of or incorrect care. The warranty also expires if you have changed an item after receiving it.

11.4 You must report obvious defects in the delivered goods, including transport damage, in writing immediately upon receipt of the goods, providing a precise description. Defects reported by you within the warranty period will be remedied by us free of charge through repairs or new delivery. If the defect cannot be remedied, you have the choice of canceling the contract or reducing the purchase price. If there is only an insignificant defect, you only have the right to a reasonable reduction in the purchase price.

12. Liability

12.1 Unlimited liability: We have unlimited liability for intent and gross negligence as well as in accordance with the Product Liability Act. We are liable for damages resulting from injury to life, body and health of persons due to slight negligence.

12.2 Otherwise, the following limited liability applies: In the event of slight negligence, we are only liable in the event of a breach of an essential contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance you can regularly rely (cardinal obligation). Liability for slight negligence is limited to the amount of damage that was foreseeable at the time the contract was concluded and which must typically be expected to occur. This limitation of liability also applies to our vicarious agents.

13. Place of performance and jurisdiction

If the customer is a merchant or does not have a place of residence within the European Union, our place of business is the sole place of jurisdiction for all disputes between the contracting parties, including bill of exchange and check claims. German law applies exclusively, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). When dealing with end consumers within the European Union, the law of the end consumer's place of residence may also be applicable, provided that mandatory consumer law provisions are involved.

14. Partial ineffectiveness

If one of these provisions is ineffective, this will not affect the effectiveness of the remaining provisions. The parties endeavor to replace ineffective provisions with effective provisions that largely achieve the intended economic purpose.
